Technical Terms of Use, Services Agreement & Network Policy
These Technical Terms of Use, Services Agreement, and Network Policies (collectively, the “Agreement”) constitute a legally binding contract under applicable law, including Ohio contract law, between Virtnet.bond, an Ohio-based service provider (“Virtnet.bond,” “Company,” “Provider,” “we,” “us,” or “our”), and the individual or legal entity accessing or using the Site or Services (“you,” “your,” or “Customer”).
This Agreement governs access to and use of: https://virtnet.bond (the “Site”); and Virtual Private Server (VPS) hosting, IP transit, BGP peering, IPv4/IPv6 allocation, and associated network services (the “Services”).
- Legal Authority, Capacity, and Acceptance 1.1 Binding Agreement and Electronic Acceptance This Agreement is enforceable under, without limitation: Ohio Revised Code § 1335.05 Ohio Uniform Electronic Transactions Act, ORC Chapter 1306 Electronic Signatures in Global and National Commerce Act, 15 U.S.C. § 7001 et seq. By accessing or using the Site or Services, you consent to electronic contracting and acknowledge that electronic acceptance constitutes a legally binding signature.
1.2 Eligibility and Authority You represent and warrant that: You are at least eighteen (18) years of age; and You possess full legal authority to bind yourself or the entity you represent.

Incorporation by Reference The following documents are incorporated by reference and have the same legal force as this Agreement: Privacy Policy Acceptable Use Policy (AUP) VPS Hosting Terms BGP Peering Policy IPv6 Abuse Policy Arbitration Agreement Incorporation is made pursuant to Ohio common-law principles of contract integration.

License to Access the Site Virtnet.bond grants a revocable, non-exclusive, non-transferable, limited license to access the Site solely for lawful purposes. Unauthorized access, scraping, reverse engineering, or circumvention of security controls may violate: Computer Fraud and Abuse Act, 18 U.S.C. § 1030 Ohio Revised Code § 2913.04 (Computer Crime)

Nature of Services and Service Model 4.1 No Common Carrier Status Virtnet.bond is not a common carrier and assumes no obligations under 47 U.S.C. Title II.
4.2 Best-Effort Infrastructure All Services are provided on a best-effort basis, without SLAs, uptime guarantees, or performance warranties, consistent with UCC § 2-316 as adopted in Ohio (ORC Chapter 1302, by analogy).
4.3 Maintenance, Interruptions, and Force Majeure Virtnet.bond may perform scheduled or emergency maintenance without liability. Service interruptions may occur due to force majeure events recognized under Ohio law, including acts of God, government action, upstream failures, or cyber incidents.

Account Information, Identity, and Verification Customers must provide accurate, current, and verifiable account information. Providing false or misleading information may result in immediate termination and may constitute fraud under ORC § 2913.02. Virtnet.bond may request verification documents consistent with KYC, anti-abuse, and carrier-compliance standards.

Customer Data, Content, and Responsibility 6.1 Ownership and Operational License Customers retain ownership of their data but grant Virtnet.bond a perpetual, irrevocable, royalty-free license as necessary to operate the Services.
6.2 No Bailment or Fiduciary Relationship No bailment, fiduciary, or custodial relationship is created.
6.3 Backup Responsibility Customers are solely responsible for backups. Virtnet.bond disclaims liability for data loss consistent with ORC § 2307.32 and applicable common law.

Acceptable Use and Network Integrity (High-Level) Use of the Services must comply with applicable law and all incorporated policies. Prohibited conduct includes, without limitation: Unauthorized access or exploitation Malware, botnets, or DDoS activity Spam, phishing, or abusive messaging Copyright infringement Routing abuse, route hijacking, or IPv4/IPv6 misuse Detailed enforcement mechanisms are set forth in Appendix B and Appendix C.

Routing, Peering, and Address Security BGP and routing activities must comply with industry standards including: RFC 4271 (BGP-4) RPKI validation (RFC 6811) Prefix filtering best practices Unauthorized route advertisements may justify immediate mitigation or termination.

Privacy and Data Handling Virtnet.bond processes personal data in accordance with: Ohio Data Protection Act, ORC § 1354.01 et seq. (where applicable) Federal Trade Commission Act, 15 U.S.C. § 45 Virtnet.bond does not sell personal data. Disclosure may occur pursuant to lawful process.

Law Enforcement and Regulatory Cooperation Virtnet.bond may preserve or disclose information pursuant to: Subpoenas, warrants, or court orders Stored Communications Act, 18 U.S.C. §§ 2701–2712 ORC § 2935 et seq. Customer notice will be provided where legally permitted.

Disclaimer of Warranties ALL SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” To the maximum extent permitted by ORC § 1302.29 and applicable federal law, Virtnet.bond disclaims all express and implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability To the fullest extent permitted by law: No liability for indirect, incidental, consequential, or punitive damages Aggregate liability capped at USD $50 Applies even if advised of the possibility of damages
12.1 No Refunds; All Sales Final
To the fullest extent permitted by applicable law: All fees, charges, and payments made to Virtnet.bond are non-refundable, non-cancellable, and final once a purchase is completed.
No refunds, credits, chargebacks, or proration are provided or owed for any reason, including but not limited to: Service suspension or termination, Enforcement of this Agreement or any incorporated policy, Alleged dissatisfaction with performance, Service interruptions, maintenance, or outages, Abuse mitigation, null-routing, or IP revocation, Law enforcement or regulatory compliance actions
Customer acknowledges and agrees that no refunds are expected or entitled after any purchase, regardless of usage, duration, or outcome. This provision applies notwithstanding any contrary course of dealing, industry custom, or expectation, and survives termination of the Agreement.

Indemnification You agree to indemnify and defend Virtnet.bond against claims arising from: Your use of the Services Violations of law Third-party claims related to your content or activity

Suspension and Termination Virtnet.bond may immediately suspend or terminate Services to: Enforce this Agreement Comply with law Protect network integrity or upstream relationships Termination does not relieve outstanding payment obligations.

Arbitration and Waiver of Jury Trial 15.1 Governing Law This arbitration agreement is governed by the Federal Arbitration Act, 9 U.S.C. § 1 et seq.
15.2 Binding Arbitration Disputes shall be resolved by binding arbitration administered by the AAA.
15.3 Class Action Waiver You waive any right to class or representative proceedings.
15.4 Small Claims Exception Qualifying claims may be brought in small claims court.

Governing Law and Venue Except where preempted by federal law: Governed by the laws of the State of Ohio Venue for permitted court actions lies in Ohio or California, as applicable

Appendix B Acceptable Use Policy (AUP) Enforcement & Network Integrity Framework
This Acceptable Use Policy Enforcement Appendix (“Appendix”) forms an integral and binding part of the Virtnet.bond Technical Terms of Use & Services Agreement (“Agreement”). Capitalized terms not defined herein have the meanings assigned in the Agreement.
This Appendix establishes mandatory enforcement procedures, technical mitigation authority, and regulatory compliance mechanisms governing the operation of Virtnet.bond’s network, hosting, IP address space, and peering relationships.
B.1 Regulatory and Legal Basis for Enforcement Virtnet.bond enforces this AUP pursuant to, and consistent with: Computer Fraud and Abuse Act, 18 U.S.C. § 1030 Stored Communications Act, 18 U.S.C. §§ 2701–2712 Digital Millennium Copyright Act, 17 U.S.C. § 512 CAN-SPAM Act, 15 U.S.C. § 7701 et seq. Federal Trade Commission Act, 15 U.S.C. § 45 Ohio Revised Code § 2913.04 (Computer Crime) Ohio Revised Code § 2913.02 (Fraud / Deception) Applicable export control, sanctions, and national security regulations Industry obligations imposed by upstream carriers, IXPs, RIRs (ARIN), and colocation providers Nothing in this Appendix shall be construed as creating common-carrier obligations under 47 U.S.C. Title II.
B.2 Enforcement Authority and Discretion Virtnet.bond retains sole and absolute discretion to enforce this AUP where it reasonably determines that an activity: Violates law or regulation Violates this Agreement or any incorporated policy Poses a risk to network stability, security, or reputation Jeopardizes upstream connectivity, IP reputation, or peering relationships Exposes Virtnet.bond to civil, criminal, or regulatory liability No prior notice is required where immediate action is necessary to protect the network or comply with legal obligations.
B.3 Prohibited Activities (Non-Exhaustive) The following activities are strictly prohibited when using Virtnet.bond infrastructure, IP space, or network services:
B.3.1 Network Abuse and Security Violations Unauthorized access, scanning, probing, or exploitation of systems Denial-of-Service (DoS/DDoS) attacks or traffic amplification Malware hosting, botnet control, command-and-control infrastructure Traffic designed to evade detection or filtering mechanisms
B.3.2 Routing and Address Space Abuse Unauthorized BGP announcements Prefix hijacking or route leaks Advertisement of prefixes not registered to or delegated by the Customer IPv6 abuse, including scanning at scale or reputation-damaging behavior
B.3.3 Messaging and Content Abuse Spam, bulk unsolicited messaging, or phishing Hosting or distributing copyrighted material without authorization Operation of piracy platforms, trackers, or indexing services Hosting content that is illegal, exploitative, or materially harmful
B.3.4 Legal and Regulatory Violations Activity violating U.S. federal law or Ohio state law Export-controlled activity without authorization Sanctions violations (OFAC-restricted jurisdictions or entities)
B.4 Detection and Monitoring Standards Virtnet.bond may utilize passive and active monitoring, consistent with applicable law, including: Flow telemetry and traffic pattern analysis Abuse desk reports from upstream providers or RIRs Automated anomaly detection (e.g., route leaks, volumetric spikes) External reputation systems (RBLs, IP blacklists, CERT advisories) Virtnet.bond does not guarantee continuous monitoring and assumes no duty to detect violations absent notice or operational necessity.
B.5 Enforcement Actions and Escalation Depending on severity and risk, Virtnet.bond may implement one or more of the following actions without liability:
B.5.1 Immediate Mitigation Null-routing (blackholing) of IP addresses or prefixes Traffic filtering or rate-limiting Temporary service suspension BGP session shutdown
B.5.2 Corrective Measures Mandatory remediation requirements Demand for technical explanation or abuse mitigation plan IP address reassignment or revocation
B.5.3 Termination Permanent service termination Withdrawal of IP space Peering termination Reporting to upstream providers, IXPs, or ARIN
B.6 Notice and Cure (When Feasible) Where operationally and legally feasible, Virtnet.bond may, but is not obligated to: Provide written notice of the violation Allow a limited cure period Request corrective action No cure period applies to: Active abuse Repeated violations Legal or regulatory risk Network-wide impact incidents
B.7 Law Enforcement and Regulatory Cooperation Virtnet.bond may preserve, disclose, or provide access to customer data in response to: Subpoenas, court orders, or warrants Lawful requests under 18 U.S.C. §§ 2701–2712 Emergency disclosures to prevent harm Where legally permitted, Virtnet.bond will attempt to notify affected Customers.
B.8 No Liability for Enforcement To the maximum extent permitted by law: Virtnet.bond bears no liability for enforcement actions Enforcement does not entitle the Customer to refunds or credits Enforcement actions do not constitute a breach of contract Customers remain liable for all fees incurred prior to enforcement.
B.9 Preservation of Network Neutrality and Carrier Independence Virtnet.bond enforces this AUP solely for network integrity, legal compliance, and risk management purposes and does not engage in content moderation beyond what is required to: Maintain infrastructure stability Comply with law Protect upstream and peering relationships
B.10 Survival This Appendix survives termination of the Agreement and continues to apply to any data, logs, or records retained pursuant to legal or operational requirements.
Appendix C Network Abuse Response, IP Governance, and Carrier Compliance Framework This Appendix is incorporated by reference into the Virtnet.bond Technical Terms of Use & Services Agreement (“Agreement”) and supplements Appendix B (AUP Enforcement & Network Integrity Framework).
C.1 Formal Abuse Response Timelines (RFC-Style) Virtnet.bond operates an abuse response process aligned with industry best practices, including guidance from RFC 2142, RFC 2350, and common NOC/CSIRT operational models.
C.1.1 Incident Intake Abuse reports may be received from: Customers Upstream providers Internet Exchange Points (IXPs) RIRs (including ARIN) CERTs / CSIRTs Law enforcement agencies Each report is logged and assigned a unique internal incident identifier.

C.1.3 Emergency Authority For P1 incidents, Virtnet.bond may take immediate unilateral action including null-routing, session shutdown, or service suspension without notice.
C.2 ARIN NRPM-Aligned IP Address Governance & Revocation Virtnet.bond manages IP address space in accordance with the ARIN Number Resource Policy Manual (NRPM) and upstream contractual obligations.
C.2.1 No Ownership of IP Resources Customers acknowledge that: All IPv4/IPv6 addresses are allocated or assigned, not sold No property or ownership interest is conveyed All address space remains subject to ARIN policy and revocation
C.2.2 Grounds for IP Revocation Virtnet.bond may reclaim, renumber, or revoke IP address assignments if: The Customer violates this Agreement or the AUP The address space is used for abuse or illegal activity ARIN policy compliance is at risk Upstream providers require withdrawal Routing security standards are violated (e.g., RPKI invalids, hijacks) Revocation may occur without prior notice where required to preserve compliance or connectivity.
C.2.3 Renumbering Obligations Customers agree to renumber services within a reasonable period upon notice and acknowledge that failure to do so may result in service termination.
C.3 Carrier Indemnity & Safe-Harbor Clause C.3.1 Indemnification of Carrier Operations To the fullest extent permitted by law, the Customer agrees to defend, indemnify, and hold harmless Virtnet.bond, its officers, employees, agents, upstream providers, IX partners, colocation facilities, and contractors from any claims, damages, penalties, or liabilities arising from: Customer traffic, content, or routing behavior Abuse complaints or enforcement actions Regulatory or legal violations attributable to Customer activity
C.3.2 Safe-Harbor for Enforcement Actions Enforcement actions taken in good faith to: Comply with law Enforce policy Protect network integrity Satisfy upstream or regulatory obligations shall not constitute a breach of contract, tortious conduct, or grounds for damages.
C.4 SOC-Style Incident Classification Matrix Virtnet.bond classifies incidents using a Security Operations Center (SOC) framework. C.5 Transparency Reporting Framework C.5.1 Aggregate Reporting Virtnet.bond may, at its discretion, publish periodic transparency reports containing aggregate, anonymized data, such as: Number of abuse complaints received Categories of enforcement actions Volume of legal requests IP address revocations
C.5.2 No Disclosure Obligation Virtnet.bond is under no obligation to publish reports or disclose enforcement details, and will not disclose information where prohibited by law or contract.
C.6 Explicit IX, Upstream, and Facility Compliance C.6.1 Supremacy of Upstream Obligations Customer usage is subject to: Upstream carrier AUPs IXP acceptable use policies Colocation facility rules RIR contractual requirements Where conflicts arise, upstream and facility requirements take precedence.
C.6.2 Immediate Compliance Actions Virtnet.bond may take immediate action to comply with: Transit provider demands IXP route server requirements Colocation security directives ARIN or regulatory notices Such actions may include service suspension, traffic filtering, or termination.
C.7 Survival and Audit Rights
This Appendix survives termination of service. Virtnet.bond may retain logs and records as required for: Legal compliance Abuse investigations Audit obligations
Appendix D — ITAR Compliance & Export Controls This Appendix D (“ITAR Appendix”) forms an integral and binding part of the Virtnet.bond Technical Terms of Use & Services Agreement (“Agreement”). Capitalized terms not defined herein have the meanings assigned in the Agreement. This Appendix establishes mandatory compliance obligations, operational restrictions, and enforcement procedures for U.S. International Traffic in Arms Regulations (ITAR), as well as related U.S. export control laws.
D.1 Regulatory Framework Virtnet.bond enforces compliance with the following: International Traffic in Arms Regulations (ITAR), 22 C.F.R. §§ 120–130 Export Administration Regulations (EAR), 15 C.F.R. Parts 730–774 Office of Foreign Assets Control (OFAC) sanctions programs Applicable U.S. federal anti-terrorism and national security laws Customers acknowledge that Virtnet.bond operates entirely within U.S. jurisdiction and that all Services, IP space, network infrastructure, and technical data may be subject to export controls under ITAR and related regulations. Nothing in this Appendix shall be construed as creating a general license for export-controlled activities.
D.2 Customer Representations and Warranties By using Virtnet.bond Services, you represent and warrant that: Non-Restricted Status You are not a national of, located in, or controlled by a country or entity subject to U.S. export sanctions or ITAR restrictions. You are not listed on any U.S. government denied parties list (e.g., OFAC, BIS Entity List, SDN List). Lawful Use Services will not be used to develop, store, transmit, or operate ITAR-controlled technical data, defense articles, or defense services without proper authorization from the U.S. Department of State. Notification Obligation You will notify Virtnet.bond immediately if any Service usage may involve ITAR-controlled materials or transactions requiring an export license.
D.3 Prohibited Activities The following activities are strictly prohibited unless properly licensed by the U.S. Department of State: Transmission, storage, or hosting of ITAR-controlled technical data or defense articles Export, re-export, or diversion of ITAR-controlled data to unauthorized foreign persons or countries Use of Virtnet.bond infrastructure to provide defense services or conduct activities requiring ITAR authorization Violation of these prohibitions may result in immediate suspension or termination of Services, IP revocation, and reporting to U.S. regulatory authorities.
D.4 Compliance Enforcement Virtnet.bond may implement any combination of the following measures to ensure ITAR compliance: Immediate suspension or termination of Services Revocation or reassignment of IP addresses Traffic filtering, null-routing, or session shutdown Disclosure of information to U.S. federal authorities as required by law No prior notice is required when immediate action is necessary to comply with ITAR or other applicable regulations.
D.5 Customer Indemnity Customers agree to indemnify and hold harmless Virtnet.bond, its affiliates, employees, officers, upstream providers, IX partners, and contractors from any claims, penalties, fines, or liabilities arising from: Customer violations of ITAR, EAR, OFAC, or related export control laws Unauthorized handling, storage, or transmission of defense articles or controlled technical data Regulatory investigations triggered by Customer activity
D.6 Recordkeeping and Audit Customers must maintain records sufficient to demonstrate compliance with ITAR and other export control laws. Virtnet.bond may request documentation or certifications to verify compliance. Virtnet.bond reserves the right to audit Customer accounts for ITAR compliance without notice.
D.7 Survival and Continuing Obligations This Appendix survives termination of the Agreement and continues to apply to any retained data, logs, or records relating to ITAR-controlled information. Customers remain responsible for compliance obligations even after Services are terminated or accounts are closed.
Appendix E — GDPR & European Data Protection Compliance This Appendix E (“GDPR Appendix”) forms an integral and binding part of the Virtnet.bond Technical Terms of Use & Services Agreement (“Agreement”). Capitalized terms not defined herein have the meanings assigned in the Agreement. This Appendix establishes mandatory obligations, operational procedures, and enforcement mechanisms for compliance with the EU General Data Protection Regulation (GDPR, Regulation (EU) 2016/679) and related European data protection laws.
E.1 Regulatory Framework Virtnet.bond enforces compliance with: General Data Protection Regulation (GDPR), Regulation (EU) 2016/679 EU ePrivacy Directive 2002/58/EC (as applicable) National data protection laws of EU member states European Commission guidance and European Data Protection Board (EDPB) guidelines This Appendix applies to any Customer, user, or data subject located in the European Economic Area (EEA) or whose personal data is processed by Virtnet.bond in connection with the Services.
E.2 Customer Representations and Obligations By using Virtnet.bond Services, you represent and warrant that: Lawful Data Processing Personal data provided to Virtnet.bond has been collected in accordance with GDPR requirements, including lawful basis for processing. Customer will not transmit or store personal data on Virtnet.bond systems in violation of GDPR. Data Minimization and Security Customer shall limit personal data collection and transmission to what is necessary. Customer shall implement appropriate technical and organizational measures to protect personal data, consistent with GDPR Article 32. International Data Transfers Where personal data is transferred from the EEA to the U.S. or other non-EEA jurisdictions, Customer shall ensure compliance with GDPR Chapter V (Articles 44–50), including any required safeguards (e.g., Standard Contractual Clauses).
E.3 Data Controller and Processor Roles Customer as Controller The Customer is the data controller of any personal data they collect or transmit. Virtnet.bond as Processor Virtnet.bond acts solely as a data processor when handling personal data on behalf of the Customer. Processing is limited to the purposes necessary to provide the Services. Data Processing Agreement (DPA) A separate DPA may be executed to formalize GDPR compliance obligations if required by Customer.
E.4 Data Subject Rights Customer acknowledges and shall enable, as required by GDPR: Access, correction, and deletion of personal data (Articles 15–17) Restriction of processing (Article 18) Data portability (Article 20) Notification of breaches to supervisory authorities and data subjects (Articles 33–34) Virtnet.bond shall cooperate with Customers to respond to requests from data subjects in a timely manner, provided Customer initiates such requests.
E.5 Data Security Measures Virtnet.bond maintains reasonable technical and organizational measures to protect personal data, including: Network segmentation and firewalls Access control and authentication Traffic encryption in transit (TLS) Logging and audit trails for abuse and incident response Regular vulnerability management Customers remain responsible for securing their own applications, systems, and data stored on Virtnet.bond infrastructure.
E.6 Data Breach Notification Virtnet.bond shall notify Customers without undue delay upon detection of any security incident affecting personal data, consistent with GDPR Article 33. Customers are responsible for notifying supervisory authorities and data subjects as required under GDPR.
E.7 Prohibited Activities Uploading or transmitting personal data without lawful basis or consent Processing sensitive personal data (special categories) without explicit authorization Transferring EEA personal data to jurisdictions without proper safeguards Violation may result in immediate suspension or termination of Services, revocation of IP assignments, and reporting to supervisory authorities.
E.8 Customer Indemnity Customers agree to indemnify and hold harmless Virtnet.bond, its affiliates, officers, employees, upstream providers, IX partners, and colocation facilities from any fines, penalties, or claims arising from: Customer violation of GDPR or other European data protection laws Unauthorized processing or disclosure of personal data Regulatory investigations or enforcement actions triggered by Customer activity
E.9 Recordkeeping and Audit Customers are responsible for maintaining GDPR-required records of processing activities (Article 30). Virtnet.bond may, at its discretion, request certifications or audit documentation to ensure GDPR compliance. Virtnet.bond may retain logs and records of personal data access or incidents as legally required.
E.10 Survival
This Appendix survives termination of the Agreement and continues to apply to any personal data, logs, or records retained pursuant to legal or operational requirements. Customers remain responsible for GDPR compliance even after Services are terminated or accounts are closed.

Acknowledgment and Agreement by Use By accessing, subscribing to, or using any Virtnet.bond Service, Site, or network resource, you acknowledge and affirm that: You have read, understood, and accepted all terms, policies, and appendices contained in this Agreement, including but not limited to: Technical Terms of Use Services Agreement & Network Policy Acceptable Use Policy Enforcement & Network Integrity Framework (Appendix B) Network Abuse Response, IP Governance, and Carrier Compliance Framework Obligations (Appendix C) ITAR Compliance (Appendix D) GDPR & European Data Protection Compliance (Appendix E) You are legally bound by all obligations, restrictions, and enforcement provisions stated herein. Your continued use of any Service constitutes explicit consent and ongoing compliance with this Agreement. No additional acceptance, signature, or acknowledgment is required beyond continued use of the Services. No refunds or credits are owed or implied for any Services rendered, regardless of suspension, termination, or enforcement actions.
By using Virtnet.bond Services, you expressly agree that all activities, behaviors, and obligations are governed by this Agreement in full.
